The Terms and Conditions of Use of the website www.houseoffiligree.com that “Hourzone - Relojoaria, Unipessoal Limitada” makes available to its potential customers, as well as the conditions applied to contracts concluded through that Web platform, are the following:

1. House of Filigree website and holder

1.1. The ‘site’ or “portal” www.houseoffiligree.com (hereinafter referred to as the ‘site’) is a website owned by Hourzone - Relojoaria, Unipessoal Limitada (hereinafter Hourzone and better identified in 1.2. of these General Conditions) which is also the owner of the brand “Hourzone” and the domain name “houseoffiligree.com”.

1.2. For the purposes of complying with applicable legal provisions, the complete identification and mandatory references of the website owner and supplier of the products offered to the public through it are as follows:

1.3. For the purposes of the legislation relating to the protection of personal data (Law 67/98, of 26 October), Hourzone, better identified in the previous paragraph, is the entity responsible for the processing of personal data that may be made available by users of the website.

2. Object, objectives and scope of application

2.1. The website is an electronic platform ‘via the web’ intended for the promotion, dissemination and sale to the public (“virtual store”) of jewelry products, accessories and similar products from brands and models sold by Hourzone.

2.2. These general conditions apply to all visitors and users of the website www.houseoffiligree.com and to all commercial transactions carried out through the aforementioned platform (“Virtual Store”) made available by this means.

2.3. Hourzone reserves the right to change these general conditions at any time. Any changes to these general conditions will come into force immediately, with the conditions in force on the date the user placed the respective order and provided the respective payment has been made.

2.4. These Terms and Conditions specifically and exclusively regulate transactions and operations carried out through the website, and are not applicable to sales made at the House of Filigree establishment (“physical store”). Likewise, any promotions or advantages made available through the website are not applicable to sales made at the House of Filigree establishment (“physical store”) and vice versa.

3. Customer/user responsibility

3.1. Registering as a user of the website and/or placing orders for products sold therein presupposes full knowledge of these general conditions and implies express acceptance by the Customer/User of all its terms and conditions.

3.2. In addition to others that are expressly provided for, the Customer/User's obligations and responsibilities are:

1. Do not use the website for purposes other than obtaining information about products and their sales conditions and/or for their acquisition;
2. Complete accurately, completely and truthfully all electronic forms relating to registration as a user, placing orders and any other forms available on the website you may use;
3. Save and not disclose your user code and access password (‘PassWord’) to third parties;
4. Do not use the website or any of the platforms and forms made available through it, to disseminate illegal, illicit or offensive content against general principles of law, ethics and public order;
5. Fully comply with all general and particular conditions relating to the website, its use and the transactions and contracts concluded through it.

3.3. Without prejudice to other contractual or legal responsibilities to which the User/Customer's conduct may be subject, Hourzone reserves the right to cancel all accounts and registrations of Users/Customers who violate any of these general conditions or whose contractual or pre-contractual conduct is objectively revealing bad faith.

4. Customer registration and placing orders

4.1. In order to place orders for products through the website, the User/Customer may choose to register in advance as a user, by filling out the respective form available online or not, and may also place orders without being registered as a user.

4.2. The User / Customer is solely responsible for the integrity, veracity and complete completion of the user registration form, as well as the orders they place. The User / Customer will also be responsible for storing and maintaining their access password (‘PassWord’) and customer code in absolute secrecy. The loss or misplacement of the access password must be immediately reported to Hourzone.

4.3. The User / Customer is responsible for keeping the data relating to their user registration up to date, including information relating to their address.

4.4. Hourzone reserves the right to cancel all User/Customer accounts and registrations that contain false or incomplete data and/or that correspond to non-existent identities.

4.5. After registering as a user, the User / Customer will be able to place orders, using the “virtual shopping cart” and following all the steps, including those relating to payment.

4.6. Validation of the order involves acceptance by the User / Customer of these general conditions, as well as the price, characteristics of the product to be purchased, delivery times and other specific conditions of the transaction.

4.7. After completing the ordering procedure, the User/Customer will receive an email containing the order number, the products purchased and other private information relating to the order in question. The User / Customer must immediately inform Hourzone if they detect any error or non-conformity in the description of the essential elements of the order, so that it can be canceled.

4.8. The User/Customer must save the order confirmation message by printing or recording it on any durable and stable medium.

4.9. In the event of an error in programming or communications, and whenever the transmitted messages do not reach the recipient in conditions where their essential elements or the essential elements of the contract are perceptible and understandable, Hourzone reserves the right to cancel and cancel the order, informing the Customer / User accordingly.

4.10. The data recorded by Hourzone relating to the Customer/User and orders placed by him/her will be stored by Hourzone and may serve as proof of the contracting of orders. At the request of the Customer / User, Hourzone will provide copies of customer records and respective orders.

5. Prices, characteristics and availability of products

5.1. The images of the products available on the website are for guidance only. When placing an order, the Customer/User must check and analyze the characteristics and descriptions of the respective products.

5.2. Each House of Filigree creation is a unique piece. As such, the size, weight and qualities of the stones may vary slightly from one piece to another.

5.3. The indicated price of the products is, unless there is an insertion error or otherwise indicated, the retail price.

5.4. The price of any purchase made through the website is valid for the day on which the order is placed and paid. Hourzone reserves the right to change sales prices to the public at any time and without prior notice.

5.5. It is possible that, despite the efforts and control mechanisms established by Hourzone, some prices indicated on the website may contain errors. If this occurs, when processing the order, Hourzone will inform the Customer / User accordingly. In such a case the User/Customer:

1. You will be refunded the difference if the advertised price is higher than the actual sales price;
2. You can choose to cancel the order, or, informed of the effective price and maintaining interest in it, pay the difference, if the effective price is higher than the advertised price.

5.6. The indication of stock availability, as well as delivery times, are merely indicative. If, as a result of the unavailability of stocks or delays in processing or dispatching the products ordered by the User/Customer, it is impossible to fulfill the order within the indicated expected delivery time, plus five working days, Hourzone will contact the User/Customer, who may choose to keep the order and accept the new delivery time indicated, or cancel it, with the amount already paid being refunded.

5.7. If the ordered product is discontinued, Hourzone will inform the customer of this fact and cancel (total or partial) the order, returning to the User / Customer the amount corresponding to the price paid for the discontinued product(s).

6. Payment and payment methods

6.1. Orders become effective after payment using one of the payment methods provided by Hourzone or for online purchases on the website.

6.2. Orders will only be processed and sent by Hourzone to the User / Customer after payment has been made.

6.3. The payment methods available for online purchases made through the website are as follows: Visa / Mastercard / American Express credit card / Payment by Multibanco reference / MBWay / Paypal and Bank Transfer.

6.4. The User / Customer recognizes and accepts that processing payments through online platforms involves security risks. The choice and option to use any payment method are the sole and exclusive responsibility of the User / Customer, who cannot attribute to Hourzone any damages or losses resulting from the use of such payment methods, unless it can be demonstrated that such damages or losses were culpably caused by any act or omission by Hourzone.

7. Delivery of orders

7.1. The website and the products on it are intended only for direct sales to the consumer, therefore Hourzone will not consider any order that, due to its objective characteristics, is not intended for sale to a final consumer, or indicates that it is a purchase for resale.

7.2. The User/Customer is solely responsible for the accurate, complete and truthful entry of all data requested in the website's user registration form and in the respective orders, including, without limitation, the address where the respective delivery must be made. Hourzone cannot be held responsible for any delay or difficulty in delivery, as well as for any delivery to an address other than the address intended by the User/Customer, whenever this results from an error or inaccuracy in the data provided by the User/Customer.

7.3. The User / Customer is responsible for, upon receipt of the order, checking that the packaging is in perfect condition and that the items comply with the order. In cases where it is visibly damaged, the User/Customer must refuse reception, mentioning the incident in the courier's delivery list and contacting the email address: info@houseoffiligree.com

7.4. Unless otherwise indicated, the expected delivery time for items within the national territory is approximately 3 to 5 business days after actual payment for the products. When counting working days, Saturdays, Sundays, national or municipal holidays, days on which working hours are decreed and days of strikes in the transport or postal services sectors will not be taken into account. Deliveries are made on weekdays between 9:00 am and 6:00 pm.

7.5. If, at the time of delivery of the order, there is no one at the indicated address, a second delivery attempt will be rescheduled by the transport company. If the second delivery attempt is unsuccessful, the order will be returned to Hourzone. In this case, the amount paid will be credited to the User/customer, deducted from transport and order processing costs.

7.6. Shipping is free for purchases with a total value of €75 or more. For orders with a lower value, the following shipping costs apply:

Mainland Portugal: €6
48h Madeira and Azores: €21
72h Madeira and Azores: €11
Spain: €7
Zone 1 (European Union): €22
Zone 2 (United Kingdom): €29
Zone 3 (Other destinations except South America and Africa): €45

Shipments are not made to countries in South America and Africa, so users from these countries will not be able to complete the checkout.

8. Instructions and other elements provided with the products

8.1. We recommend carefully and fully reading the instructions and other documents that accompany the products before using them.

8.2. All elements supplied with the product (including respective packaging and any accessories) are essential for the eventual return or exchange of the product (see 9 below). The respective purchase invoice is absolutely necessary to exercise the rights arising from the legal guarantee (see 10 below).

9. Returns and right of withdrawal

9.1. In accordance with applicable legislation (DL no. 24/2014, of February 14th, amended by Law 47/2014, of July 28th) the User / Customer has a period of 14 days (including Saturdays, Sundays and holidays), from the day on which the items are delivered to the indicated address, to terminate the contract, without paying compensation and without needing to indicate the reason.

9.2. The right referred to in the previous number must be exercised by the User / Customer by filling out the Free Resolution Form (legally approved model) on the website, which is attached to these general terms and conditions.

9.3. If you exercise the Right of Withdrawal, the User/Customer must deliver, at their own expense, the products delivered to them, in the exact condition they were in at the time of delivery, accompanied by the respective warranty certificate(s), instructions and other documents that accompany the products, their packaging, any accessories that accompany them and the respective purchase invoice at any Hourzone store. The costs of returning products due to the exercise of the right of free resolution will always be borne by the User / Customer.

9.4. All elements supplied with the product (including respective packaging and any accessories) are essential for the eventual return or exchange of the product. The warranty certificate and the corresponding purchase invoice are absolutely necessary to exercise the rights arising from the legal guarantee or any voluntary guarantee provided by the respective manufacturer (see 10 below).

9.5. If the User/Customer wishes to exercise the right of withdrawal, under the terms set out in 9.1. and 9.2., without the product(s) sent to you being returned to Hourzone, within a maximum period of fourteen days from the date on which you exercised the right of withdrawal, the notice of termination will have no effect and the amount paid for the product(s) will not be refunded to the User/Customer. The same will apply if all the elements referred to in 9.3 are not returned in perfect condition.

9.6. Once the products have been returned, Hourzone's technical services will analyze them and verify the condition they are in and the effective return of all the elements referred to in 8.2.

9.7. Exchanges or returns will not be accepted on products that show signs of use or misuse (including, but not limited to, scratches, signs of falling, knocks or “bumps”). In these cases, Hourzone will not refund the amount paid for the products in question and will refund them to the customer, in the condition in which they were received.

9.8. Exchanges or returns will not be accepted on items personalized by the customer or customized according to their specifications.

9.9. After analysis by Hourzone's technical services, and if the returned products meet the aforementioned conditions, the amount paid by the User/Customer will be returned within a maximum period of fourteen days from the date on which Hourzone received the communication referred to in 9.2. or the date on which the product was actually returned to Hourzone, if such return occurs on a date after the communication of resolution.

9.10. The credit will be made in order to guarantee speed in the process and greater convenience for the Customer, and carried out according to the payment method chosen for the initial order within the maximum period referred to in the previous number and in the following way:

1. Visa / Mastercard / American Express / Paypal / MBWay credit card: Amount to be refunded credited to the Credit Card or Paypal / MBWay account used for the order.
2. Payment by Multibanco reference: Amount credited to the bank account after indication by the customer of the IBAN used to pay for the order.
3. Payment by Bank Transfer: Amount credited to the bank account used for the order.

9.11. At the time of exchange, the customer may exchange it for any other product on the website, as long as it is of equal or greater value.

10. Warranty and technical assistance

10.1. All products sold through the website benefit from a legal guarantee of two years from the date of purchase by the User / Customer.

10.2. The following will not be repaired or replaced under warranty, as the following are excluded:

1. Products that show signs of misuse, improper handling or use contrary to what is stated in the respective instructions. These cases include, in particular, without limitation, products that show signs of falling, blows or accidents;
2. That have been subject to unauthorized modifications and/or repairs;
3. Quick-wear accessories that accompany the products; 

10.3. The provisions of these conditions regarding guarantees in consumer sales do not prejudice or affect the consumer's rights established in Decree-Law 67/2003, of April 8th, with the changes introduced by Decree-Law 84/2008, of May 21st. Broader rights conferred by the Manufacturer's International Guarantee or by the guarantee granted by the importer, under the terms set out therein, are also not affected.

10.4. If, for any reason, the product is not covered by the warranty but the fault is repairable, Hourzone will contact the User / Customer, and present a repair quote that will be submitted for prior approval by the Customer.

11. Personal Data and Privacy Policy

11.1. Hourzone, better identified in paragraph 1.2. above is the entity responsible for processing personal data provided by website users.

11.2. By providing the data, the user/client accepts that it may be collected and processed for the purposes of advertising, marketing (including through any means of direct marketing and unsolicited advertising communications, as long as the user/client does not object), commercial and/or promotional offers, purchase and sale of products, statistical processing of purchases and sales, placing and managing orders, technical and after-sales assistance.

11.3. The User / Customer accepts that the data provided by him and/or relating to him may be transmitted and used for any of the purposes referred to in paragraph 11.2. to companies that are in a group relationship with Hourzone, meaning: companies in which Hourzone participates; companies in which companies participate; companies that hold part of Hourzone’s share capital; or, companies that are participated in by companies holding part of the share capital of Hourzone.

11.4. The data provided may also be transmitted to the carrier / postal service, exclusively for the purpose of delivering and processing orders placed and providing information about such delivery and processing.

11.5. Hourzone will implement and maintain appropriate technical and organizational measures to protect data against accidental or unlawful destruction, unauthorized dissemination or access, tampering or loss, thus seeking to ensure the integrity and confidentiality of personal data. Such measures include backup mechanisms, permissions and authorizations for reserved access and processing, with a view to preventing access by unauthorized third parties (other than the User / Customer holding the data, in relation to the data that directly concerns them, Hourzone, the entities that act on their behalf in the processing of the data, their duly qualified personnel and the entities referred to in number 11.3.).

11.6. Hourzone is obligated by itself, by the entities contracted by it to process the data, by its workers and collaborators and by the entities referred to in paragraph 11.3. to maintain strict secrecy regarding confidential data and information that it becomes aware of through the ‘Site’, and is only authorized to use it for the purposes set out in these general conditions, for the exercise of any right within the scope of contracts concluded with the User/Client, or following a legitimate order from any judicial or administrative authority.

11.7. Without prejudice to the provisions of the previous paragraphs, Hourzone warns and the Customer accepts that the collection, dissemination and processing of data on open networks involves risks, and the data may be seen and used by unauthorized third parties, even against the will and regardless of the contribution or knowledge of Hourzone and the User / Customer, therefore Hourzone or any entity authorized to process the data, cannot be held responsible for such unauthorized access. On the other hand, when using the 'Site', whether from the perspective of User or from the perspective of content viewer, the User / Customer may be exposed to content that, contrary to and regardless of Hourzone's wishes, violates these terms and conditions or applicable legal regulations, and Hourzone or any entity authorized to process the data cannot be held responsible for such acts.

11.8. Hourzone guarantees and guarantees to the Customer, in accordance with applicable legislation and without additional charges, the right of access (including, without limitation, rectification and updating of their personal data), namely by filling out the form on houseoffiligree.com

11.9. Hourzone and the entities referred to in number 11.3. above, may preserve and maintain the data for as long as necessary to ensure full compliance with the contracts that may be concluded with the User / Customer - including, without limitation, for the purposes of warranty and after-sales assistance - which includes the right to preserve and use the data, for the aforementioned purposes, even after the aforementioned contracts or agreements cease to take effect, for any reason and after the period of exercise of the right of free resolution.

11.10. The Privacy and Processing of Personal Data Policy is applicable to any data provided by the User / Customer in the processes and procedures for registering on the website, placing orders and to any data provided through the www.houseoffiligree.com platform or provided following such registrations and orders.

A. Intellectual Property

A.1. The intellectual property rights (including copyright, related rights, industrial property rights and sui generis rights) over the website, its functionalities, its programming, databases that support it, its contents, its brand and domain name, are the property of Hourzone.

A.2. The rights to some content on the website, including, without limitation, images, brands, logos, product names and descriptions are the property of the manufacturers, licensors, distributors or importers of the products that are promoted, advertised and sold on it. Hourzone cannot be held responsible for the unauthorized use that the User / Customer or anyone accessing the website may make of such materials or content.

A.3. Any use for purposes other than obtaining information and purchasing products is expressly prohibited and requires the express and prior consent of the respective rights holder. The User / Customer or any person accessing the website is prohibited from, in particular, without limitation, the transformation, adaptation, reproduction, making available, representation or use for different purposes, in whole or in part and throughout the world, of any content or materials protected by copyright, related rights, sui generis rights or industrial property rights, such as those referred to in the preceding paragraphs.

A.4. The rights referred to are protected by national and international standards and the provisions of the preceding paragraphs do not prejudice more restrictive regimes contained in these standards.

B. Applicable Legislation. Jurisdiction of Portuguese Courts

B.1. Portuguese Law is applied to the use of the website, as well as to transactions, contracts and businesses concluded through it, and to the interpretation and application of these general conditions.

B.2. The Portuguese Courts have exclusive jurisdiction to resolve any dispute arising from the use of the website, transactions, contracts and businesses concluded through it or the application of these general conditions.

C. Legal information to be provided to the consumer

C.1. Information on the Right to Free Resolution (as referred to in paragraph j of paragraph 1 of article 4 of DL no. 24/2014, of 14 February, amended by Law 47/2014, of 28 July).
The consumer has the right to freely terminate this contract within 14 calendar days, without needing to indicate any reason. The period for exercising the right of free resolution expires 14 days from the day following the day on which you acquire or a third party indicated by you, other than the carrier, acquires physical possession of the goods. In order to exercise your right of free termination, you must communicate to us, using the contact details below, your decision to terminate this contract by means of an unequivocal statement (for example, a letter sent by post, fax or email).
